These Terms of Use constitute a legally binding agreement between you (“you” or “your”) and Trends.fun (“Trends,” “we,” “our,” or “us”) and govern your access to and use of the Trends platform and related services (collectively, the “Services”).

The Services may be provided by Trend Labs Limited or any of its affiliates.

By accessing the Trends Platform and/or using the Trends Services, you agree that you have read, understood and accepted these Terms, together with any additional documents. You acknowledge and agree that you will be bound by and will comply with these Terms, as updated and amended from time to time.

If you do not understand and accept these Terms in their entirety, you should not use the Trends Platform.

IMPORTANT NOTICE: ARBITRATION AND CLASS ACTION WAIVER. THESE TERMS CONTAIN (1) A WAIVER OF ANY RIGHT TO PARTICIPATE IN A CLASS ACTION OR OTHER REPRESENTATIVE PROCEEDING AND (2) A MANDATORY ARBITRATION PROVISION THAT GOVERNS THE RESOLUTION OF CERTAIN DISPUTES. SUBJECT TO APPLICABLE LAW, THESE PROVISIONS AFFECT YOUR LEGAL RIGHTS, INCLUDING WAIVING YOUR RIGHT TO SUE IN COURT OR HAVE A TRIAL BY JURY FOR COVERED CLAIMS. PLEASE READ CLAUSE 27 (DISPUTE RESOLUTION) AND CLAUSE 28 (CLASS ACTION WAIVER) CAREFULLY.

RISK WARNING

The value of Digital Assets can fluctuate significantly and there is a material risk of economic loss when buying, selling, holding or investing in Digital Assets. You should therefore consider whether trading or holding Digital Assets is suitable for you taking into account your personal circumstances, financial or otherwise.

Please ensure that you fully understand the risks involved before using the Trends Platform and Trends Services.

You acknowledge that we are not your broker, intermediary, agent or advisor and we have no fiduciary relationship or obligation to you in connection with any activities you undertake when using the Trends Platform. We do not and are not providing any investment or consulting advice and no communication or information that we provide to you is intended to be, or should be construed as, advice of any kind.

Any information or content made available by Trends is provided solely for general informational and educational purposes and does not constitute legal, tax, accounting, investment, or other professional advice. You acknowledge that Trends is not registered or licensed as a broker, dealer, exchange, or investment adviser (or equivalent) in any jurisdiction, and the Trends Platform may not have been reviewed or approved by any regulator.

You are responsible for determining whether any investment, investment strategy or related transaction is appropriate for you in light of your personal investment objectives, financial circumstances and risk tolerance and you are responsible for any associated loss or liability. We do not recommend that any Digital Asset should be bought, earned, sold or held by you. Before making the decision to buy, sell or hold any Digital Asset, you should conduct your own due diligence and consult your financial advisor. We are not responsible for the decisions you make to buy, earn, sell or hold Digital Assets based on the information or services provided by us, including any losses you incur arising from those decisions.

Additional Risk Disclosures

Without limiting the generality of the above Risk Warning, you acknowledge and agree that using the Trends Platform and engaging with Digital Assets involves significant risks, including the following:

1. Technology and operational risks. The Trends Platform, Digital Assets, and the software, networks, protocols, systems, and other technologies underlying Digital Assets may be novel, experimental, and complex, and their terms, features, and risks may not be fully understood. The Trends Platform may experience interruptions, delays, errors, bugs, or other malfunctions, including due to high demand, internet connectivity issues, or other factors.
2. Irreversible transactions and address errors. Digital Asset transactions may be irreversible. Digital Assets may be lost if sent to an incorrect address (including due to formatting errors, typographical errors, or sending to an incompatible address or network). You are solely responsible for verifying transaction details before submitting any Instruction.
3. Blockchain/network events. Digital Assets may be affected by forks, chain reorganisations, consensus failures, validator/miner attacks, “51% attacks,” double-spend attempts, smart contract vulnerabilities, or other adverse events affecting the security, integrity, availability, or operation of a blockchain network or smart contract (each, a “Network Event”). Network Events may impact the value, functionality, or availability of Digital Assets and may cause delays or losses.
4. Cybersecurity risks and scams. You and your Wallet(s) may be targeted by malware, hacking, phishing, spoofing, social engineering, Sybil attacks, denial-of-service attacks, wallet-draining attacks, and other malicious activity. No technology is completely secure. You are responsible for protecting your devices, accounts, private keys, seed phrases, passwords, and authentication credentials.
5. Third-party dependency risks. We may rely on third-party providers and infrastructure (including cloud service providers, hosting providers, data centres, Wallet providers, liquidity venues, blockchain RPC providers, and other vendors) for aspects of the Trends Platform. Failures, outages, interruptions, service degradations, breaches, insolvencies, or changes in terms by third parties may impair or prevent your access to the Trends Platform or the completion of Transactions.
6. Third-party services and integrations. The Trends Platform may contain links to, integrate with, or display information from third-party services (including decentralised applications, blockchain explorers, analytics services, and social media services). We do not control and are not responsible for third-party services, including their availability, accuracy, security, or legality. Your use of third-party services is at your own risk and may be subject to separate terms.
